Schick Xtreme3 – Ultimate Adventure
Official Rules

  1. PROMOTIONAL PERIOD: The Schick Xtreme3 – Ultimate Adventure contest (the “Contest”) commences at 12:00 am (ET) on June 23, 2011 and will end at 11:59 PM (ET) on December 31, 2011 (the "Contest Period").
  2. ELIGIBILITY: To enter the Contest and be eligible to win a Prize, a person (“entrant”) must be a legal resident of Canada who has reached the age of majority in his/her province/territory of residence at the time of entry into the Contest. Employees, officers, and directors (including members of the same household of such persons, whether related or not) of Energizer Canada Inc., (the “Sponsor”), its affiliates, agents, participating stores, advertising or promotional agencies, and the independent contest organization are not eligible to enter the Contest.

    The Sponsor has the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, accurate, complete, and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any such entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate, or misleading personal details and/or information.
  3. HOW TO ENTER: No Purchase is Necessary. To participate in this promotion, you will need to describe in your own words “How you would use $5,000 CDN for an Xtreme Adventure” (Maximum 300 characters – approximately 50 words or less). To enter the Contest: (1) go to www.xtreme3adventurecontest.ca and click on the “Get Entry Details” button; (2) describe in your own words “How you would use $5,000 CDN for an Xtreme Adventure” (Maximum of 300 characters – approximately 50 words or less in either English or French); (3) complete the on-line Entry Form with your first name, last name, daytime phone number including area code, and email address; (4) read and accept the Official Rules; (5) indicate if you would like to start receiving future e-mail updates, communications from the Sponsor (not mandatory for entry). (6) and select “Submit” (herein defined as the “Entry”). Upon receipt of your Entry, you will receive an on-screen “thank you” message. All entries must be received by 11:59 PM (ET) on December 31, 2011 (the “Contest Closing Date”).
  4. ENTRIES: Limit of one (1) Entry per person during the Contest Period, therefore only one (1) e-mail address may be used by any person participating in the Contest. Any person who is found to have entered more than once during the Contest Period will be disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void. All entries become the property of the Sponsor upon receipt and none will be returned.

    Entries must be in “good taste” and in keeping with the Schick Xtreme3 brand image and may not contain profanity, be libelous or be offensive, as determined in the sole discretion of the Selection Committee and/or the Sponsor.

    Entrants cannot be professional writers. An Entry must be the entrant's original creation, executed and created solely by the entrant and must not have been published previously or won any other award. Modifying, enhancing or altering a third party's pre-existing work does not qualify as entrant's original creation. The right to submit an entry must not be restricted in any way. An Entry cannot defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person's, entity's or organization's personal or proprietary rights, including but not limited to, intellectual property rights. The Sponsor’s right to use the Entry shall not be restricted in any way. Upon submission of an Entry, each entrant grants the Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such Entry and the concepts embodied therein in any way, in commerce, in perpetuity and in any and all media worldwide, without limitation or approval by or compensation to the entrant and the entrant may be required to sign a release to that effect. Submission of an Entry further constitutes the entrant's consent to irrevocably assign and transfer to or waive in favour the Sponsor any and all rights, title, interest and claim, which he/she now has or may have in the future, to the Entry, and the concepts embodied therein, including without limitation, the copyright and/or moral rights therein. Such rights, title and interest shall include, but are not limited to, all intellectual property, sales, and licensing rights. The entrant should ensure that his/her Entry does not contain any commercial content that promotes any product or service other than those offered by the Sponsor and another named party.
  5. SUITABILITY FOR PUBLICATION: The Sponsor reserves the right at any time during the Contest Period to reject any Entry if in the sole opinion of the Sponsor acting in its absolute discretion, the Entry would be inappropriate, dangerous or would violate or offend any law, regulation, order, governmental policy, public policy or third party’s rights or could potentially expose the Sponsor to law suits, (for example by containing any commercial content that promotes any product or service other than those of the Sponsor), embarrassment, contempt, ridicule, or adverse publicity or otherwise reflect unfavorably on the Sponsor or any of its products or services.
  6. PRIZE: There will be (1) Grand Prize (the “Prize”) available to be won. The Prize will consist of $5,000 CDN. The $5,000 CDN will be issued in the form of a cheque payable in the Winner’s name as it appears on his/her Entry Form. The Prize must be accepted as awarded without substitution and is not transferable or assignable.
  7. RANDOM DRAW: A random draw will be made by the independent contest organization in Oakville, ON at approximately 10:00 AM (ET) on January 9, 2012 (the "Draw Date") to select one (1) eligible entrant from all eligible entries received by the Contest Closing Date. Odds of winning depend on the total number of eligible entries received by the Contest Closing Date. The selected entrant will be contacted by email within five (5) business days of the Draw Date. The Sponsor will make two (2) attempts to notify the potential Winner at the email address submitted on the on-line Entry Form. In the event that the selected entrant cannot be contacted by email, or if there is a return of any notification as undeliverable, then the selected entrant will be disqualified, and his/her entitlement to receive the Prize will be forfeited and an alternate eligible entrant will be randomly selected from among the remaining eligible entries. The above process will be repeated until such time as contact is made with an eligible selected entrant or there are no more eligible entrants available. Prior to being declared the winner, the selected entrant must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered by telephone or email at a mutually convenient time within the seven (7) business days of the notification. In the event that the selected entrant incorrectly answers the mathematical skill-testing question, he/she will be disqualified and another eligible entrant will be randomly selected from among the remaining eligible entries and the above process will be repeated. This process will be repeated until such time as there is one (1) confirmed winner (a “Winner”) or there are no more entries remaining.
  8. RELEASE FORM: The selected entrant must complete and return the Sponsor’s Declaration of Compliance and Release of Liability and Publicity Release Form (the “Form”). By completing and returning the Form, and accepting the Prize, the Winner confirms compliance with the Official Rules, acknowledges that the Prize must be accepted as awarded and cannot be substituted or transferred, releases the Sponsor, its respective affiliates, advertising and promotional agencies, the independent contest organization, and their respective shareholders, directors, officers, employees and agents from and against all liability in connection with the Contest and/or the awarding and use of the Prize, and consents to the use of his/her name, address (city and province/territory), essay, and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity (in a form acceptable to the Contest Sponsor) from any entrant participating in this Contest, or purportedly entered, to be considered valid for the purposes of this Contest. Failure to provide such proof in a timely manner may result in disqualification of the entrants that cannot be verified to the satisfaction of the Contest Sponsor, in its sole and absolute discretion. The Form must be returned within the time period specified on the Form or the Prize will be forfeited. The Sponsor or a designated agent will send within forty-five (45) days by mail or courier the Prize upon receiving the fully completed Form.
  9. CONDITIONS OF ENTRY: By entering the Contest, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by the Official Rules and by the decisions of the independent contest organization, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification.
  10. If a dispute arises regarding who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the entry.
  11. GENERAL: The Sponsor and the independent contest organization do not assume any responsibility and are not responsible for (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with the Official Rules; (ii) any loss, damage, or claims caused by an awarded Prize or the Contest itself; or (iii) any failure of the website during the Contest Period, including any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person's computer related to or resulting from downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest. Entry material/data that has been tampered with or altered is void.
  12. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with (i) the laws of the Province of Québec and the laws of Canada applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Contest is subject to all Federal, Provincial, and Municipal laws.
  13. The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate the Contest and conduct a random draw from all previously received eligible entries.
  14. FOR QUEBEC RESIDENTS: Any litigation respecting the conduct and awarding of the Prize in this Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
  15. CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. If you consented on the Entry Form, the Sponsor may use the information you provide to initiate, maintain, and develop a relationship with you in connection with the offering of the Sponsor’s products or the promotion and marketing of additional products and services offered by the Sponsor. You may revoke your consent at any time by writing to Schick Consumer Affairs Canada, P.O. Box 537, Neenah, WI 54957 USA. If you did not consent on the Entry Form, the information you provided will only be used to conduct the Contest.
